The goal of DIESEL S.p.A. ("the Seller") is to ensure complete satisfaction to the Buyer in regard to products carrying the brand name "DIESEL" and "DIESEL BLACK GOLD” on the Site (hereinafter referred to as "Buyer" and "Products", respectively). If for any reason the Buyer is not satisfied with his/her order ("Order"), he/she may exercise his/her right of withdrawal, without any penalty, within thirty (30) calendar days from the day on which the Products, included in the Order, were received or if, at the time of purchase, he/she has requested delivery to a single-brand store with the "DIESEL" sign, listed in the "Shipping" area of the Site, and if available in the country of purchase of the Products ("Point of Sale"), within thirty (30) calendar days from the date on which the Products, included in the Order, are collected from that Point of Sale.      The Products returned must be delivered to the shipping carrier indicated by the Seller within thirty (30) days from the date of receipt of the Products listed in the Order, or must be handed over to a sales assistant at the Retail Store, among those listed on the Site, within thirty (30) days of receipt of the Products. Except in case of return of Products directly at a Retail Store, the Products may be returned by the Buyer by shipping using the services of a carrier indicated by the Seller or through other shipping means only after filling out the return form (according to the standard form under Annex 2 of Book VI of the Belgian Economic Law Code), that the Buyer will find inside the parcel in which the Products ("Return form") will be delivered.


The right to return Products will be deemed to have been exercised once the following conditions have been fully fulfilled:

a. unless the Products are returned at a Retail Store, the Return Form or any other form indicating explicitly the decision of the Buyer to withdraw from the Contract must be properly completed and submitted to the Seller within thirty (30) days from receipt of Products or, if upon purchase the Buyer requested delivery at a Retail Store, from the pick-up date of the Products listed in the Order at the Retail Store;

b. the Products must not show signs of use, wear, wash, or damage in any way;

c. the identification tag must still be attached to the Products in its original state;

d. the Products must be returned in their original packaging intact;

e. the returns items must be shipped back to the Seller within thirty (30) days from the time the Buyer informed the Seller of its decision to terminate the Contract or, if the Buyer chooses to return the Products directly at a Retail Store, the Products must be handed over to a store assistant within thirty (30) days from the date of receipt by the Buyer, of the same Products.

Subject to the exceptions permitted by the Seller, if all the conditions required to proceed with the return are met, the Seller will proceed to refund the Buyer in full for the amount of the returned Products. If the Buyer decides to use the courier indicated by the Seller to ship the purchased Products, the Buyer will not have to pay the costs of the return, as the costs will be borne by the Seller, who will pay for the service provided by the courier. It is understood that the Seller may withhold, from the reimbursement due to the Buyer, a sum equal to the cost previously borne by the Seller for the delivery to the Buyer of the Products ordered. It is understood that, if the Buyer decides to use a courier other than the one indicated by the Seller, the Buyer will have to pay in full the costs of the return.

If the Buyer decides to return the Products at a Retail Store, no expenses will be incurred. However, in this case, the Buyer must fill out the Return Form. The Buyer should return to the sales assistant of the chosen Sales Point the Products and the original packaging in which the Products were originally delivered to the Buyer within thirty (30) calendar days of receipt of the Products. The Seller requires the Buyer, in order to proceed with the return, to fill in the Return Form, on which the Buyer is also required to specify the reasons for the return, and this for statistical purposes only.

Notwithstanding the foregoing considerations in terms of acceptance of the return and time and method of refund, if the Buyer paid for the Products listed in the Order using the cash on delivery method and wishes to be refunded directly in its current account, the Buyer can communicate its IBAN to the store assistant at the Retail Store to be inserted in its database of personal details. The Buyer will be notified if the returned Products cannot be accepted because owing to a lack of conformity with the abovementioned conditions. In this case, the Products will be returned.In the event that the Buyer refuses the delivery, the Seller reserves the right to retain the Products and the amount corresponding to the purchase price of the same and the amount relating to shipping costs.The Seller may authorise the sales assistant operating at the Point of Sale where the Buyer makes the return, to check the Products returned by the Buyer, in order to ascertain that all the conditions for exercising the right of withdrawal referred to in the previous paragraph are met. If the Buyer decides to make use of the return procedure provided for in this paragraph, he/she must be physically present at the Point of Sale for as long as necessary for the sales assistant to check the Products. In the event that the conditions set forth above are met, the sales assistant will provide instructions to the Buyer on the methods of reimbursement, which will be based on the method of payment adopted at the time of purchase. Upon acceptance of the reimbursement, the Buyer will receive a confirmation e-mail, unless it is impossible to proceed for reasons beyond the control of the Seller and/or the sales assistant (by way of example, force majeure, malfunctioning - even temporary - of hardware or software equipment). The reimbursement will be made by the Seller, based on the method of payment used by the Buyer to purchase the returned Products. If the return request is not accepted, the Products will be returned immediately to the Buyer. 


After the Seller received the return and checked that all the requirements were met, the Buyer will receive an e-mail confirming acceptance of the return, or, in case of a decrease in the value of the returned Products occurred, the Buyer will receive an e-mail communicating the amount subtracted by way of deduction of the refund. Notwithstanding the payment method used by the Buyer (e.g. credit/debit card, PayPal, or cash on delivery), the refund will be processed by the Seller as soon as possible and within fifteen (14) days from date when the Buyer makes known its exercise of the right of return, once it is asserted that the return was carried out in observance of the relevant terms and conditions.

The time frame to credit the amounts owed or to return the sums paid by the Buyer for the purchase of Products is contingent upon the payment methods used, as specified below:

purchase by credit/debit card: the repayment time depends on the management company of the credit/debit card, but occurs within fourteen (14) days.

It is acknowledged that the value date of the re-crediting shall be the same with that of the direct debit, thus no losses will be incurred in regards to bank interest.

purchase through PayPal: refunds will be credited to the PayPal account and will be immediately visible. The actual refund to the credit card connected to the PayPal account depends on the institution that issued the card and will occur within fourteen (14) days.

Cash on delivery: the refund is made to the current account indicated by the Buyer, therefore the refund time depends on the accuracy of the data that is entered or communicated to the sales assistant of the Store, if you have chosen to return the Products directly to the store, as specified below; normally the refund is made within fourteen (14) calendar days.
If, as described in the last sub-paragraph of the previous paragraph, "Conditions for the exercise of the right of withdrawal", the return is made at a Store, and all the conditions for processing the return request are met, the sales assistant is entitled to verify the Product and to proceed with the authorization to refund the price of the same, the refund will be authorized instantly to the payment method used for the purchase. 


All Products offered sold by the Seller bear an identification label, which is part of the Products. Products must be tried on without removing the tag, as Products returned to the Seller without this label will not be accepted.


The Products retuned can be dispatched using the shipping carried indicated by the Seller, using the printed adhesive label included in the packaging of the Products delivered. This method allows the Seller to pay, on behalf of the Buyer, the delivery and tracking fees incurred for the shipment, tracking the parcel containing the Products throughout its delivery route. The Buyer can contact the shipping carrier to arrange the return of Products. If the Buyer decides to return the Products using a shipping carrier other than those indicated by the Seller, the Buyer must pay for the return fees and will be fully liable for loss or damage of Products during the transport.
